EU Data Act Now in Effect: What It Means for You

We would like to inform you that the EU Data Act officially came into effect on September 12th, 2025, across the European Union. This important legislation empowers users and businesses by enhancing access to data generated by connected devices, such as smartwatches, vehicles, smart TVs, and industrial machinery.

What Is the EU Data Act?

The Data Act establishes clear and fair rules for data access and sharing, aiming to foster innovation, competitiveness, and growth in Europe’s digital economy. It complements the Data Governance Act by providing legal clarity on how data can be accessed and used.

Key Benefits

  • Users gain control over the data generated by their connected devices.
  • Devices must be designed to enable data sharing.
  • Consumers can choose more cost-effective repair and maintenance options or perform these tasks themselves.
  • Industrial users (e.g., in manufacturing or agriculture) can access performance data to improve operations.
  • Cloud users can switch providers or use multiple services simultaneously.
  • Unfair contractual terms that restrict data sharing are prohibited.
  • The European Commission has also published guidance on vehicle data sharing, supporting better repair services, car sharing, and mobility-as-a-service solutions.

To support implementation, the Commission will:

  • Launch a Data Act Legal Helpdesk to assist companies with compliance.
  • Provide guidance on trade secret protection in the context of data sharing.
  • Publish model terms and standard clauses for data sharing and cloud contracts.
  • Introduce a Data Union Strategy to further streamline the EU’s data framework.

The Commission has worked closely with companies, industry associations, and civil society to ensure clarity and practicality in the Act’s provisions. Stakeholder engagement will continue to shape future guidance and ensure effective, proportionate implementation.
